These Terms and Conditions were created in order for our therapists and patients to be treated with respect, and also to provide clear rules for mutual cooperation.
These Terms and Conditions bind unconditionally our patients and Magda Clinic. If you use our services, it means that you read, understood and agreed to these Terms and Conditions.
Magda Clinic’s Commitment to You
All our patients receive respectful care to the best of our knowledge and abilities.
You won’t be discriminated against based on your age, gender, ethnicity, beliefs, sexual preference or health status.
We respect all patients and their families and you will be treated with courtesy.
The Magda Clinic Guarantee
We believe that we provide the highest quality services. However, we also understand that the human body is a very complicated system and the results might vary from patient to patient and from case to case. The same treatment might be successful for one patient and unsuccessful for another one.
Therefore, sometimes the results of the treatment might be not as good as you expected or there might even be no results. In some rare situations, you can even feel worse just after the treatment.
That might make you feel unhappy with the services we provided. Therefore, if you are unhappy with our services, please contact us via the contact form within 7 days after the treatment. You will receive a full refund.
Feedback
We appreciate your feedback. Good feedback proves that we provide good services and encourages us to work even harder. Negative feedback shows that there is still room for improvement.

Cancellations
Time is the only thing we cannot recover. Therefore, in Magda Clinic we have a very simple but strict cancellation policy.
- You as our patient book an appointment and if you can’t come you must cancel it. In other words, the appointment will stand unless you cancel it.
- 24-hour cancellation notice is required – you can cancel your appointment free of charge if it’s more than 24 hours before the appointment. Please cancel your appointment as soon as you know that you cannot come.
- If you don’t cancel your appointment 24-hours prior to your session you must pay for your appointment regardless of the reason you cannot come. Please read more here about why we have such a strict cancellation policy and what to do if you cannot come. You agree that we charge your card for that payment.
We do our best to remind you about your appointment via SMS and/or email; however, the technology is not foolproof. As mentioned above, the appointment still stands unless you cancel it. If you don’t receive the SMS and/or email or you don’t confirm or cancel the appointment, it still stands, and you will be fully charged for it.
Late cancellation fees are paid by the patient and cannot be covered by Health Funds.
Late appointment
If you are late, we can still provide a service for you but it will be shorter and finish at the scheduled finish time. The next patient will be waiting and their session must start at the planned time.
Unfortunately, you will have to pay the full price for your session as we spent that time waiting for you.
We advise that you come 5-10 minutes before your session. More time is needed before your first session.
Please take into consideration traffic and all other obstacles that might prevent you from being on time.
Please be advised that a 1-hour session includes: welcoming, initial conversation about the treatment, undressing (if needed), massage or beauty treatment and dressing. The effective treatment time during a 1-hour session is about 55 minutes.
Missed appointment (no-shows)
You must pay full price for a missed appointment regardless of the reason.

Missed appointment fees are paid by the patient and cannot be covered by Health Funds, WorkCover, DVA, Medicare or other government agencies and private companies.
If your session is delayed by us
Therapists have enough time between the sessions in order to start your session on time. However, sometimes they might be late. If it happens, we will try to provide your session in full. If it won’t be possible, we will adjust the price for the session accordingly.
If we cancel your appointment
It might happen that our therapists are sick or there is another reason that we cannot provide the service you booked.
We will notify you about it via email, SMS or phone and we will try to reschedule your appointment to another time convenient for you.
Any deposit you made for the appointment cancelled by us will be used to pay for your next appointment. The deposit will be refunded if we cannot find a time that is suitable for you.
Why do we have such a strict cancellation and no-show policy?
As mentioned before, we have limited time during the week to help our patients with their needs. In our clinic we treat pain, serious conditions and improve the well-being of our patients and therefore it is important that we can use that time effectively.
When you book the appointment, you book the time at which we can help you. During that time we could also help other patients who need it. Therefore, it is so important to cancel your appointment at least 24h prior to your session as it gives the chance for another patient to book a visit.
Moreover, every hour counts for the financial viability of the business. If you cancel late or miss your appointment it impacts the business.
What to do if you can’t come and it is less than 24 hours before your session?
There is no point losing a treatment if you must pay for the session. We encourage you to offer your time slot to a family member, friend or colleague from work. It might be a gift or maybe you can recoup the full or partial costs from them.
Consent to Treatment and Full Disclosure
You, as our patient, give our therapists the consent to perform all necessary treatments in accordance with their training, knowledge and understanding of your condition.
You inform our therapists about all your conditions and contraindications and discuss your needs, expectations and nature of the treatment before it will be provided.
You understand that Massage Therapy and Beauty Therapy require physical contact (touch) and you consent to that.
You have the right to stop the session at any time.
You understand and accept that the treatment can cause adverse effects including but not limited to: stiffness and soreness, soft tissue injury, neurological complications, cerebrovascular injuries, skin irritations, burns and other minor complications.
The therapist may inform you about other options if massage or beauty treatment risk is high.
Consent to Obtain and Release Information
We may need to contact other people to provide treatment for you, including treating practitioners, rehabilitation consultants, case managers and employers. We may request some information about you and we may pass some information to them.
You will be provided with a form to sign on your initial consultation to consent to this.
Personal Conduct
We ask you to treat our employees with respect.
During the treatment you must wear underwear at all times.
The therapist can cancel the treatment and leave the treatment room immediately if there is any harassment either physical, verbal or sexual.
A police report might be filed if the charges are deemed to be of a serious nature.
The therapist uses a towel to respect your privacy and uncovers the part of your body that they are working on at that time.
Please immediately communicate:
- If you feel uncomfortable
- You need specific attention to any part of your body
- Prefer firmer or lighter pressure
- Need a glass of water or anything else
- Would like to change the style of massage
The therapist will try to do their best to accommodate your requests.
Health Conditions
You must inform the therapist about any health conditions that might impact the treatment. We advise you to consult with your GP about any contraindications for the therapy and seek the doctor’s approval.
Some contraindications for massage might be (this is not a full list):
- Cuts or open wounds
- Bruises
- Varicose veins
- Broken bones
- Burns
- Some skin conditions
- Fever
- Contagious diseases
- Blood clots and other blood diseases
- Pregnancy
- Kidney conditions or Liver conditions
- Cancer
- Inflammation
- Uncontrolled hypertension
- Other ongoing medical treatments
Accounts and Billing
Prices
The most current prices for our services are displayed during the booking process.
Payments
It is expected that all fees are paid in full before or at the time of consultation.
Payment methods
We accept cash, EFTPOS and credit cards and offer electronic health rebates (via HICAPS) for your convenience.
Full payment is still required on the day of consultation or treatment in the event of electronic network failure.
Credit, debit and prepaid card surcharges apply and they are compliant with Australian Competition and Consumer Commission (ACCC) regulations; in particular, they are not excessive and higher than the real costs of an electronic transaction. Cash payment is always an option.
Health Rebates
If electronic health rebates are unavailable, an electronic invoice will be sent to you for manual claiming.
Health Insurance rebates (electronic or otherwise) can only be claimed after the service has been received. In the instance of purchasing treatment packages, rebates will only be available once the treatment package has been completed.
Card details stored in our system
You agree that we charge your card stored in our electronic system for the services rendered, products purchased, late cancellations and missed appointments.
Refunds
There is no refund available on the purchase of any personal or healthcare items if you change your mind. If the item is faulty, we can either refund or exchange the item for you. Please keep your proof of purchase.
Gift Vouchers are non-refundable and cannot be redeemed for cash.

Please understand that our strict billing methods allow equality of service to all patients, and serve to raise the already high standard of care we can offer you. That policy also supports the financial viability of our local business.
Anti-discrimination
We do not discriminate against any person or prevent them from accessing our services. Our practice is a private business, and we must remember about the financial aspect of that activity. We acknowledge that there are other businesses providing the same or similar services and their prices and Terms and Conditions might be different.
Our patients have the right to choose our competitors or discuss with us our Terms and Conditions and the reasons behind them.

Privacy Policy Summary Statement
All patient details are stored confidentially with your clinical notes and they are not disclosed to anybody outside our clinic, unless it is required by law or you agreed to that.

The information you provide is gathered for the primary purpose of providing Massage Therapy and Beauty Therapy. That information can be accessed by all therapists and the admin team.
Where required by law or if necessary for debt collection reasons, your personal information will be disclosed.
Our clinic contacts patients via SMS and/or email to keep you up to date with the status of your appointment. We also occasionally email material regarding promotions, discounts, updates, products and services. You consent to that by using our services and you may opt out of that type of communication at any time.
Advertising
By using our services, you agree that we will advertise our services to you or contact you by using your contact details such as phone number, email address or home address.
You always have the option to opt-out by contacting us via email.
We do not sell any contact details.
Exclusion of Liability
The Owner and employees of Magda Clinic shall not be liable for, nor shall they accept any responsibility for any injury, loss or damage howsoever sustained by any person or persons arising out of any of the treatments or procedures delivered in this Clinic or in any way whatsoever that does not arise from any negligent act or omission of the Owner and employees.
